Legal Considerations

WARNING! It is forbidden to use the name of “Politia Animalelor” by any legal person, institution, state, private entities, public entities, territorial administrative unit (municipality), Community policies, regardless of the sector to Bucharest, or all over the country, according Excerpt from Law no. 84/1998 amended by Law no. 66/2010.

This law provides the following:

Article 30
(1) Registration of name takes effect starting at the date of its filing.

Article 36
(1) name registration gives the holder an exclusive right over it.
(2) name holder may request the competent court to prohibit third parties from using it.
(3) In applying paragraph. (2), the holder may request the name of third parties to be banned:
d) using the sign on business papers and advertising.

Article 37
(1) An applicant for registration of the name may require that third parties are prohibited to perform acts referred to in art. 36.

Article 90
(1) an offense punishable by imprisonment from 3 months to 3 years or a fine of 50000 to 150000 lei if committed without right, of counterfeiting.

 

 

Extract from the rules of the GENERAL INSPECTORATE OF POLICE FOR ANIMAL PROTECTION - ANIMAL POLICE car on the status of equipment:

Article 26

(2) cars dedicated to the I.G.P.P.A. will be printed and properly equipped, with special media platform with acoustic and light warning, according to law obtained certificate of registration no.019 223 dated 26.7.2010, referred to in art. 1 letter. A reference to information made ​​public in the Official Gazette, no. 87 dated17.03.2010 and will be conducted only by staff of the FCSC -IGPPA being required to move their roadmap;

(5) As to the art. 32, par. 2, lit. A and B of O.U.G. no. 195/202, the principles of law: ”Where the law does not distinguish, we do not have to distinguish,” said the legal text referring to ”police”, but without distinction, as it is road, the community, for animal protection, etc.. and the application and interpretation of legal rules is done with the general principles of law, ownership can not be disturbed, and the law must be interpreted in favor of the beneficiary, not against him.

Below we present documents proving registration of the name “Animal Police” and the establishment of the Police General Inspectorate for Animal Welfare - Animal Police, the Commissioner for Civil Society Federation.

CHAPTER II

MISSION, OBJECTIVES AND ACTIVITIES I.G.P.P.A.

7 (1) Mission I.G.P.P.A. - Animal Police raises awareness of the public opinion on adopting a rational and humane behavior towards animals and the need to comply with laws governing their rights to animals as beings who live in social environment or in the wild;

(2) Animal Police shall not replace any state authority, entitled by law to apply sanctions with fines or confiscation, but they can continue efforts started by the extra-judicial investigations, according to art. 1 para. 2, lit. e, of this Regulation;

(3) The Animal Police belongs to the NGO sector, as with specialized NGOs affiliated or collaborating to deter those who cause suffering to animals, also involving in their actions  state authorities;

 

DUTIES, RIGHTS AND ACTIVITY OF THE I.G.P.P.A. POLICEMAN

Art.9 IGPPA policeman, regardless of hierarchical position held may perform the following activities:

monitoring implementation of the normative imperative and its harmonization with the acquis of the field;
drafting and presentation of management reports FCSC, on the findings of the activities specified in Section 1;
I.G.P.P.A. police will find facts contravention of pet owners referred to in the specific legislation and will issue written notices or warnings with concrete proposals to remedy the situation found;
I.G.P.P.A. police will participate in monitoring and oversight of how wild animals are fed in zoos, in shelters of associations, mayors, etc.. where stray dogs and other animals housed stray or confiscated by the competent authorities;
will monitor how they are fed, groomed and exploited animals in farms in the districts they represent;
will monitor how animals are transported and sold in markets, other similar facilities etc.. and operating conditions in their farms or adequate space, do not cause suffering or injury to any animal;
I.G.P.P.A. police authorities may request assistance under the Ministry of Administration and Interior (Gendarmerie, Police, ISU, etc.) in the missions they carry out, after receiving some complaints about acts of cruelty, maltreatment, etc.. against the animal if it finds that his life is endangered;
for adoption by local government of Decisions of local councils to individualization of facts and a contravention of delegations of jurisdiction by the decision of the mayor, the powers of the police finding IGPPA offenders, they will respect the legal framework, namely the HCL and the provisions of Ordinance 2 / 2001, amended, acting as agents of the administrative-territorial entity, and requiring notification to the competent authorities applying sanctions, especially for deeds that are not stipulated in special laws. Under the Cooperation Protocol signed between IGPPA that county inspectors and administrative-territorial units, police IGPPA will teach the end of working hours, a copy of the minutes prepared copy was found in the notification notice. The minutes of finding the notification will be recorded in a special register kept at the territorial center.

10. other duties of the police I.G.P.P.A. will be recorded in the job description, according to the hierarchical position occupied;

 

CHAPTER IV

EXECUTIVE LEADERSHIP

Article 10 (1) I.G.P.P.A. is represented centrally  by an General Inspector, in his capacity as head of this structure and the local level(county / local) by the principal Chief Inspectors, Inspectors who exercise their powers under this Regulation and job description;

(2) In a separate working capital Inspectorate headed by a Municipal Inspector, Regional Leader of Bucharest, which has the subordinated Chief Inspectors who coordinates the activity of each sector;

11 (1) The Superior Council F.C.S.C. may approve the establishment of inspectorates abroad, given the provisions of the legislation of the receiving State;

(2) The Superior Council F.C.S.C. approves the establishment and dissolution proposal Inspector General IGPPA structures the country and abroad. Decision establishment and dissolution of these structures is signed by the Commissioner General and countersigned, advisory, by General Inspector.

(3) The General Commissioner advisory opinion of the Supreme Council FCSC, which is part of the IGPPA, decides on classification of functions and functional organization established IGPPA, pointing out the decisions made by the General Inspector, in view of their implementation;

 

CHAPTER X

COMMISSION OF HONOR

Article 31 The Commission of honor of  the I.G.P.P.A. structure is composed of political, cultural and artistic personalities with reputation, who can, by their involvement contribute to the development of the image of and Animal Police in general, who have agreed to support the IGPPA, to encourage its work;

32 Honorary Committee meets once a year, presenting the results of activity of  IGPPA and may make amendments on the organization and its presentation before the state authorities and foreign similar governmental structures;

33 The conduct of economic activity - will be specified financial in an annex to this Regulation;

I.G.P.P.A. hereinafter referred to Animal Police is a structure of the civil society, being a personal data operator no. 19 162, registered at the National Supervisory Authority for Personal Data Processing, and is subject to Law no. 677/2001 on the protection of individuals regarding the processing of personal data and free movement of such data.
